1. Agreement to Terms

By accessing or using NavioWorks ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

NavioWorks is a vessel management platform that provides tools for maintenance planning, procurement, and compliance management. The Service is designed for professionally crewed vessels and is provided on a subscription basis.

3. User Accounts

You must provide accurate and complete information when creating an account
You are responsible for maintaining the security of your account credentials
You must notify us immediately of any unauthorized access to your account
You may not share your account with others or allow others to access the Service using your credentials
One account per person; shared accounts are not permitted

4. Your Data

You retain all rights to the data you enter into NavioWorks. We do not claim ownership of your content. You grant us a limited license to host, store, and display your data solely for the purpose of providing the Service.

You can export your data at any time in standard formats
You can request deletion of your data at any time
We will not access your data except as necessary to provide support or as required by law

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to gain unauthorized access to any part of the Service
Interfere with or disrupt the Service or servers
Reverse engineer or attempt to extract the source code
Use the Service to store or transmit malicious code
Resell or redistribute the Service without permission

6. Subscription & Payment

Subscriptions are billed in advance on a monthly or annual basis
All fees are non-refundable except as required by law
We may change pricing with 30 days notice
You may cancel your subscription at any time; access continues until the end of the billing period
We reserve the right to suspend accounts with overdue payments

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We will provide reasonable notice of planned maintenance when possible.

8. Limitation of Liability

To the maximum extent permitted by law:

The Service is provided "as is" without warranties of any kind
We are not liable for any indirect, incidental, or consequential damages
Our total liability is limited to the amount you paid us in the 12 months preceding the claim
We are not responsible for decisions made based on data in the Service

9. Indemnification

You agree to indemnify and hold harmless NavioWorks, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

10. Termination

We may terminate or suspend your access immediately, without prior notice, for:

Breach of these Terms
Non-payment of fees
Conduct that we determine is harmful to other users or the Service

Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the Service. Your continued use after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of Spain. Any disputes shall be resolved in the courts of Málaga, Spain. This does not affect your statutory rights as a consumer under the laws of your country of residence.
